Arpaio's attorneys wrote to Obama administration officials, questioning whether investigators followed ethics rules in launching the probes this year.


Robert N. Driscoll, a District-based lawyer for Maricopa County who served as a civil rights official at the Justice Department early in the George W. Bush era, said he was seeking "assurances that political rivalries and score settling played no role in the investigations."

In his letter, Driscoll said that a civil rights probe of the Arpaio operation began in early March, weeks after four influential Democrats on the House Judiciary Committee called for an investigation into alleged discrimination and possible constitutional violations in arrests and in police searches and seizures.

The investigation appeared on a list of accomplishments the Justice Department prepared for reporters in April, after the Obama administration had been in office 100 days. Attorney General Eric H. Holder Jr. has said that reinvigorating the enforcement of civil rights laws is a high priority.

The civil rights unit at the Justice Department has itself been a focus of intense interest. In a report this year, the department's inspector general uncovered ideological motivations behind the hiring and transfer of career lawyers during part of the Bush administration.

The measure, passed by the House 385 to 35, directs the Internal Revenue Service (IRS) to issue the rebate checks to so-called “resident aliens” who don’t need to prove their legal presence in the United States. Resident aliens are classified by the Treasury Department based on how long they have lived in the U.S. and the agency uses unofficial information provided by the alien.

Since the stimulus bill was considered under a procedure in the House that did not allow an amendment to restrict payments to illegal aliens, millions stand to benefit from the measure. That means a large portion of the money will be sent back to the home countries of the illegal immigrants.

MERRY CHRISTMAS AL SHARPTON AM SUBPOENA SLAP

Teams of federal agents swooped down on up to 10 close associates of the Rev. Al Sharpton Wednesday, demanding the flamboyant clergyman's financial records since 2001.

Sharpton's former chief of staff said he was roused at his Harlem home about 6:30 a.m. by two FBI agents who handed him a subpoena to bring the records to a federal grand jury the day after Christmas.

Several employees of Sharpton's National Action Network also got wakeup subpoenas to testify before the Brooklyn panel, the rabble-rousing reverend's lawyer said.

The FBI and IRS are investigating whether Sharpton improperly misstated the amount of money he raised during his 2004 White House run to illegally obtain federal matching funds, a source familiar with the probe said.

Sharpton, although forced to return $100,000 in matching taxpayer funds after an investigation two years ago, denied any wrongdoing at the time.

The feds are also looking into allegations of tax fraud, including whether Sharpton commingled funds from his nonprofit National Action Network with several of his for-profit ventures, the source said.

Lawyer Michael Hardy shrugged off the probe, which sought a vast array of business, political and personal records, as a federal fishing expedition.
